Getting Started

What kind of things can I use Kinzin for?
Kinzin is for keeping in touch, sharing photos, recipes, memories, events, milestones and more. Family and friends might be spread out all over the world, but now you can drop in and see what everyone is up to, whenever you want.

I just created a Kinzin account, what should I do first?
First, invite your friends and family; it’s more fun when the whole clan gets together. Then, start sharing! Write about what’s new in your own life in your journal. Create a new photo album with the pictures from your latest vacation.

Is there a limit to the number of families I can have?
Yes, the limit is five families. Use these families for all of your families: your spouse’s family, your mom’s family, your dad’s family, your nuclear family and anything else that you consider to be family. There are no limits to the amount of members each family can have. Every member can belong to up to five different families.

How do I create a new family?
You can create a new family from anywhere on the site. Simply click the “Create a family” button in the top right corner, give your family a name, invite members and you’re done.

How do I invite my family and friends to Kinzin?
Click on ‘invite new members’ from almost anywhere on the site (it’s a button on the left side of the screen). Fill in their address and which family(ies) you’d like to invite them to. They’ll be emailed an invite with a link to join Kinzin.

Why do you have the word “beta” attached to your logo?
Although it does add a bit more color to our logo, we’ve added it for another reason. It signifies that Kinzin is currently in beta phase of development. A beta version is the first version available to the general public for the purpose of evaluation and testing. As a result, you might experience a few kinks and hiccups. However, thanks to feedback from community members like you, we’re resolving these issues on a daily basis. If there is anything we can do to make your experience a little better, please let us know.

My Page

What is “My Home”?
“My Home” is all about you. It’s the virtual face you present to your Kinzin world, the view of you that your family and friends will see. It’s the place where you start, add photos or write stories…..it’s your own special spot.

What are messages for?
Messages are for communication within the family - you can only send messages in Kinzin to other members of your family. You will also get occasional general site notifications in your message center. Also, if you’re a site administrator, you will receive administrative notices (like requests to join the family) in your message center.

How can I change my profile image?
From your home page, click “Change profile portrait” under your current photo. You can then upload a new photo to replace the old one.

Privacy

Who can see my photos, journal or recipes?
You control who sees your content. You can choose to share your content with any, all or none of the family groups you belong to on Kinzin. Only members of the family that you chose to share with will be able to see your content. And you can change your permissions at any time. However, once you share a photo or a story with a family, it becomes part of the family asset pool, so even if you delete it in your personal space, it will still live in the family space. You’ll have to contact the family administrator to have it permanently deleted.

Will Kinzin use my photos or stories for publicity or promotions?
We would like to feature the amazing work that Kinzin members create. But we will never re-use anything without your approval and consent.

What do you do with my personal information?
If you purchase something using Kinzin, we may use it for billing information (to charge your credit card, for example, we need your address). Kinzin will never sell or re-use your personal information. We won’t send you up Spam Creek without a paddle…..we promise!

What kind of content can I upload to Kinzin?
Data uploaded to Kinzin is the sole responsibility of the person from whom the content originated (that’s you). Make sure you read the “Terms and Conditions” of the site to make sure that the content you’re putting on Kinzin fits within our boundaries of acceptable content. Kinzin will not tolerate illegal content.

Administrative

How do I change my password?
To change your password, sign in, and go to “Account Settings” from your home page and click ‘Reset password’. We’ll send you a link to the email addresses registered to your account. Follow it back to Kinzin and choose a new password.

I forgot my password and need to get back in.
From the sign-in page, click on “Forgot password”. After you enter your email address, we’ll send you a link by email. After you follow it back into Kinzin, you’ll be prompted to enter a new password.

How do I change my email address?
To change the email address you use with Kinzin, sign in, and click on ‘edit’ beside your profile on your home page. You can change your email address or even add multiple addresses.

Can I block a particular family member?
If you’re the family administrator, you can remove family members from your family group. If you’re not the family administrator, you can send a message to your family’s administrator through Messages.

How can I cancel my account with Kinzin?
We’ll certainly be sorry to see you go. When you’re signed in, go to ‘account settings’ from your home page and find the link to send an email to Kinzin. You’ll need to specify in your email that you would like to have your account permanently deleted. Please be aware that this means that all of the content you uploaded may be deleted. if you shared content with your families, they keep copies of those shared items. And remember, you can always just leave a family; you don’t have to leave Kinzin altogether.

How do I change my displayed name on Kinzin?
To change your displayed Kinzin name, go to your own profile page, and edit your profile. From your own home page, click on Edit next to your profile or personal details. Change the name to what you’d like displayed and save.

If I remove a family member from my group, will their Kinzin profile all their content be deleted?
If you are the administrator of a family, you have control over who belongs and who doesn’t belong to your family. If you remove a person from your family, they will be notified by email. Even if they are removed from a family, they still have access to their personal space on Kinzin, other families that they may belong to, and all of the content that they have uploaded or contributed.

What can I do if someone has offensive material or is harassing other members?
Start with your family administrator; perhaps there was just a misunderstanding. If your family administrator can’t resolve the situation and you believe someone is abusing their Kinzin account, contact Kinzin customer service, and we’ll investigate.

How are families administered?
There is only one administrator per family. The person who sets up the family becomes the administrator. They are notified when new members are invited to the family and can remove members from their family group.

Journal

What is the “Journal” page?
The ‘Journal’ is the same as a diary or blog, a place to record present and past events, stories, news……or a place you can rant and rave, and take comfort in knowing your readers are those who love you the most.

How do I add stories to my journal?
To add a new journal entry, click on ‘write a story or news’ from almost anywhere.Then you just give your entry a title, description, date and save it, and share it.

Who can view my journal entries?
Your journal entries visible to any family member when they view your profile. You can choose to publish one or more of your journal entries into the any of the families to which you belong.

How do I change a journal entry I wrote?
To change a journal entry, click on ‘Edit’, make your changes, click ‘Save’ and it’s updated.

How do I delete my journal entries?
If you’ve shared your journal entries with a family and they’ve been re-used to make a photo album or recipe collection, you can’t really delete your journal entries. Kinda like if you gave a letter to your Uncle Jim, you’re not going to get it back either. However, if you shared your journal entries with a family and they weren’t re-used, you will be able to delete them.

How do I add photos to my journal stories?
In the text editor, you can add photos by clicking on the photo icon on the far right (hint: it’s a tree). Pick from photos you’ve already uploaded, or add a new one to the system. We’ll automatically resize and add in the photo with your text flowing around it.

How do I remove images from my journal?
To remove images from your journal entries, click on the photo and delete it from the entry. Don’t worry, when you remove photos from a journal entry, they’re not deleted from the system. They’ll still appear in your photo album.

Can I add videos to my journal stories?
No, not in this version of Kinzin. Video support is on our development schedule.

Can I upload audio files?
No, not in this version of Kinzin. Audio support is on our development schedule.

Family Pages

What are “Family” pages?
‘Family’ pages are a hub, a central place where everyone’s latest photos and news is brought together. This is the place to go when you want to see what’s new, keep up to date, check in with the family and see what everyone is sharing.

Can I customize my “Family” pages?
Right now, the family administrator has the ability to choose the color of the family’s tab which changes the color for the whole family page. Look for more customization options in the future.

How do I join an existing Kinzin family?
There are two ways to join an existing Kinzin family. First, someone in that family can send you an invitation. You’ll get an email with a link that you can click to be added to the family. The other way is to search for the family in the “Family Directory”. If you find a family that you’d like to join, you can send an email to the Administrator of that family and request an invitation.

How do I join an existing Kinzin family through the “Family Directory”?
You’re only 6 steps away:
1. Create a Kinzin account
2. Click “Add a new family” in the menu bar
3. Click “Find families” in the menu bar
4. Using the alphabet lineup or the search option, find your family.
5. Click on the desired family name.
6. Click “Request to join”

Why would I want more than one family group?
Well, there are a lot of reasons for having more than one family. Some people use family groups to organize the different sides of their family (e.g. your spouse’s family, your dad’s family). Some people use multiple family groups to share content with a book club or mommy group, rather than their relatives. There are all kinds of uses for multiple family groups. You get up to 5, so try them out - we’re sure you’ll find a creative use for them!

Photos & Photo Album

What is the “Photo Album” page?
The ‘Photo Album’ page is where you can see your latest photos as well as th photo sets your family members have shared.

How do I upload an image? Or multiple images?
To upload an image, you can click ‘Upload a photo’ from anywhere on the site, . From there you can upload one photo or multiple photos at the same time.

Who can see my photos?
The only people who will be able to see your photo are the members of your family or families.

How do I share my photos with friends?
Invite them to Kinzin and when they set up a free account, you’ll be sharing photos in no time!

Why do I want to say who’s in a photo?
Every Kinzin member (you) will get a photo strip of other peoples photos that feature them (you). Neat, eh? So you’ll have your photos (the photos you’ve added), photos you’re in (other people will be in these photos with you), and photos of you (just you in these).

How did you figure out the date I took my photo when I uploaded it?
Your digital camera automatically adds the date to your photo in the file information. So if you scan a photo to upload it, the scanner makes the date the date of the scan - not the photo. If you’re scanning old photos, you’ll probably want to change the date to when the photo was taken, or at least guess at when it was taken.

What file format do my images need to be?
The files need to be JPG, GIF or PNG.

Why can’t I upload my RAW files from my camera to Kinzin?
To see images on the Internet, they need to be JPG, GIF or PNG. Your digital camera probably came with software to convert your RAW files into one (or all) of these formats.

What size should i upload my photos?
Computer magic resizes your photos for you, so upload away!

Is there a limit to how many photos I can upload?
There is currently no limit to the amount of photos that you can upload to Kinzin!

How do I reorder photos in albums?
In the photo strip for the album, you can re-order photos by dragging them into a new position. Click on ‘Add photos’ and re-order the photos from the set in the pop-up window.

How do I delete my photos?
If you’ve shared your photos with a family and they’ve been re-used to make a photo album or recipe collection, you can’t really delete your photos. Kinda like if you gave a print of your photo to your Uncle Jim, you’re not going to get it back either. Calendar

What is the different between “Event” and “Milestone”?
An event is something that happens in the future, and will perhaps be something that you invite people to. A milestone is something that happened in the past, like your child’s first step, or your high school graduation. Don’t worry, both of them show up in the calendar.

Comments

Why do I want to leave a comment?
Commenting is just another great way to communicate, like letting someone know you like their photo or adding something to a journal entry. Comments are just a different sort of family conversation.

Who can see the comments I leave?
The comments can be seen by any member of a family. Only invited family members can view the content you put onto the site. Sometimes, you (or someone you know) will belong to many families. So, if someone you know shares a story with a family you’re in and a family you’re not in, Kinzin members you may not know will see it.

Can anyone leave a comment?
Only members of the family(ies) that you chose to share your content with can leave comments.

Recipes

How do I see other members’ recipes?
To see recipes that are shared by a family, go to the family and click on ‘Recipes’. If you want to see just one person’s recipes, go to their profile and you’ll be able to see only their recipes.

How do I attach photos to a recipe?
In the text editor, when you’re editing your recipe, you can add photos by clicking on the photo icon on the far right of your screen (hint: it’s a tree). You can pick from photos you’ve already uploaded, or you can add a new one to the system. We’ll automatically resize and add in the photo with your text flowing around it, making your recipe look all the more appetizing.

The Information We Collect

Kinzin.com may also collect information about you from other sources, such as newspapers, blogs, instant messaging services, and other users of the Kinzin.com service through the operation of the service (e.g., photo tags) in order to provide you with more useful information and a more personalized experience.

Use of Information Obtained by Kinzin.com

When you register a family with Kinzin.com, you create your family’s profile and privacy settings. Your profile information, as well as your name, email and photo, are displayed to people in family group(s) that you specified in your settings.

Profile information is used by Kinzin.com primarily to be presented back to and edited by you when you access the service and to be presented to others permitted to view that information by your privacy settings.

Profile information you submit to Kinzin.com will be available to users of Kinzin.com to whom you allow access to the information through your privacy settings (e.g., your family groups). If you choose to make your family group public, your family group’s name will be available in search results across the Kinzin.com network and those limited pieces of information may be made available to third party search engines. This is primarily so your relatives and friends can find you and send a request to connect. People who see your name in searches, however, will not be able to access your profile information unless they have a relationship to you (e.g., friends and relatives, friends of friends and relatives etc.) that allows such access based on your privacy settings.

Kinzin.com will send you only service-related announcements from time to time through the general operation of the service. For instance, if a family member sends you a new message, you may receive an email alerting you to that fact.

Generally, you may not opt-out of these communications, which are not promotional in nature. If you do not wish to receive them, you have the option to deactivate your account.

Kinzin.com may use information in your profile without identifying you as an individual to third parties. We do this for purposes such as aggregating information and personalizing advertisements and promotions so that we can provide you a better service at Kinzin.com. We believe this benefits you. Where there are advertisements, they’re more likely to be interesting to you. For example, if you put chocolates as gift ideas in your profile, we might serve an advertisement for gourmet chocolates. But we don’t tell the gourmet chocolate company who you are.

Sharing Your Information with Third Parties

Except as explained above, or where you are expressly informed otherwise, we do not sell, rent, share, trade or give away any of your personal information, unless required by law or for the protection of your Membership. Welcome to Kinzin, an Internet-based service that connects and allows you to share content with your family. The Kinzin service, available through the kinzin.com website, the Kinzin network (collectively, “Kinzin” or the “Service”) are operated by Kinzin, Inc. and its corporate affiliates (collectively, “us”, “we” or the “Kinzin Companies”). Registration Data; Account Security

Upon providing Registration Data to us through the Service, you will receive a password and account (your “User Account”). You hereby agree to be fully responsible for (a) all use of your User Account, (b) any action that takes place using your User Account by any person or automated process, (c) maintaining the confidentiality and security of the password to your User Account, and (d) immediately notifying us upon any unauthorized use of your password or your User Account.
Content; Licenses
In these Terms of Use, “Content” means all materials and content of any type, including, but not limited to, photos, graphics, images, designs, profiles, messages, information, notes, text, information (including Registration Data), music, sound, video, articles, and software.
We do not claim ownership over any Content that you submit to, transmit to, upload to, copy to or make available on the Service (collectively, your “User Content”). Your User Content includes any Content submitted to, transmitted to, uploaded to, copied to or made available on the Service using your User Account. By submitting to, transmitting to, uploading to, copying to, or making available on the Service any User Content, you grant the Kinzin Companies the worldwide, royalty-free and non-exclusive right and license to (a) use, distribute, reproduce, modify, adapt, publicly perform and publicly display such User Content solely for the purpose of our commercial provision and promotion of the Service, and (b) to sub-license your User Content in accordance with these Terms of Use. This license will be in effect while your User Content is included on the Service. Your User Content will be deemed to be included on the Service from the time you submit, make available, upload or copy such User Content onto the Service until you or we remove or delete such User Content from the Service.
All Content available or stored on the Service other than your User Content, including (a) all other Users’ User Content and (b) the selection and arrangement of all such Content and User Content (collectively, the “Service Content”), is the proprietary property of us, the Users or our licensors with all rights reserved, and the Kinzin Companies (or, as applicable, our Users or licensors) retain and shall retain all right, interest and title therein and thereto.
Provided that you are eligible for use of the Service, and you agree to these Terms of Use, we hereby grant you a limited, personal, non-transferable, revocable (at any time with or without notice or cause) and non-exclusive right and license to access and use the Service and to download or print a copy of any portion of the Service Content solely for your personal, non-commercial use, subject to these Terms of Use and provided that you keep all copyright or other proprietary notices intact. Any other use of the Service or the Service Content is strictly prohibited. Without limiting the foregoing prohibition, and except with respect to your own User Content, you may not (a) modify, copy, distribute, frame, reproduce, republish, download, display, post, transmit, or sell in any form or by any means, in whole or in part, Service Content, or (b) republish any Service Content on any Internet, Intranet or Extranet site or incorporate the information in any other database or compilation, without our prior written permission. Furthermore, you may not use any data mining, robot or similar data gathering or extraction methods with respect to any Service or any Service Content.
Any use of the Service or the Service Content other than as specifically authorized herein, without our prior written permission, is strictly prohibited and will terminate all licenses granted by us herein. Such unauthorized use may also violate applicable laws including, without limitation, copyright, privacy, trade-secrets and trademark laws and applicable communications regulations and statutes. Unless explicitly stated herein, nothing in these Terms of Use shall be construed as conferring any other license to intellectual property rights, whether by estoppel, implication or otherwise.
Trademarks
Notwithstanding anything else in these Terms of Use, KINZIN, ALL TOGETHER NOW, the KINZIN logo and design, “The Zin” magazine and other trade-marks, trade dress, graphics, logos, designs, page headers, button icons, scripts and service names used by the Kinzin Companies on or in connection with the Service (collectively, the “Marks”) are registered trademarks, trademarks or trade dress of the Kinzin Companies or our licensors and all right, title and interest in and to the Marks, whether registered or not, are and shall remain vested in us or in our licensors, as applicable. The Marks may not be used, including as part of trademarks, trade names, trade dress or as part of domain names, in connection with any product or service in any manner that is likely to cause confusion and may not be copied, imitated, or used, in whole or in part, without our prior written permission.
User Conduct
You acknowledge and agree that, except for self-service advertising programs offered by us on the Service (for example, Kinzin blog badges), the Service is available for your personal, non-commercial use only. You represent, warrant and agree that no User Content violates or infringes upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary rights, or contains libelous, defamatory or otherwise unlawful material. You further agree not to harvest or collect email addresses or other contact information of other Users of the Service by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications. Additionally, you agree not to use automated scripts to collect information from the Service for any purpose. You further agree that you may not use the Service in any unlawful manner or in any other manner that could damage, disable, overburden or impair the Site. Without restricting the foregoing, you also agree not to use the Service to:
• upload, post, transmit, share, store or otherwise make available any User Content that is, in our sole discretion, harmful, threatening, unlawful, defamatory, infringing, abusive, inflammatory, harassing, vulgar, obscene, fraudulent, invasive of privacy or publicity rights, hateful, or racially, ethnically or otherwise objectionable;
• register for more than one User Account, register for a User Account on behalf of an individual other than yourself (except if you are the parent or legal guardian to such individual), or register for a User Account on behalf of any group or entity;
• impersonate any person or entity, or falsely state or otherwise misrepresent yourself, your age or your affiliation with any person or entity;
• upload, post, transmit, share or otherwise make available any unsolicited or unauthorized advertising, solicitations, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation;
• upload, post, transmit, share, store or otherwise make publicly available on the Service any private information of any third party, including, without limitation, addresses, phone numbers, email addresses, Social Insurance Numbers, US Social Security numbers, credit card numbers, financial information and other personally identifying or private information;
• solicit personal information from anyone under 18 or solicit passwords or personally identifying information from any person for commercial or unlawful purposes;
• upload, post, transmit, share or otherwise make available any material (including all User Content) that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
• “stalk”, intimidate, harm or otherwise harass another User or another person;
• upload, post, transmit, share, store or otherwise make available content (including all User Content) that would constitute, encourage or provide instructions for a criminal offense, violate the rights of any party, or that would otherwise create liability or violate any local, state, national or international law;
• intentionally or unintentionally violate any applicable local, state, national or international law, including any regulations thereto, or any court order or lawful order of any governmental authority;
• interfere with or disrupt the Service (including the servers, networks or technology connected to the Service);
• upload, post, transmit, share, store or otherwise make available any User Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (including, but not limited to, inside information, trade secrets, confidential information, and employer information);
• use or attempt to use another’s User Account or the Service without authorization from us, or create a false identity on, or provide false Registration Data to us through, the Service; or
• upload, post, transmit, share, store or otherwise make available content that, in our sole discretion, is objectionable or which restricts or inhibits any other person from using or enjoying the Service, or which may expose us or our Users or licensors to any harm, damage or liability of any type.
Nudity and Adult Material
You acknowledge and agree that the Service must remain a safe site for families with children, so you agree not to, and we strictly prohibit, the uploading and display of any User Content portraying explicit nudity, adult content, or that is otherwise unacceptable for viewing by minors, in our sole discretion. For example, prohibited User Content would include material that would be unacceptable in a public museum where minors visit, or User Content that would only be appropriate for adult sites, adult magazines, or R-rated movies. You acknowledge and agree that the sole discretion of whether User Content is suitable belongs to us, and we reserve the right (but have no obligation) to (a) delete any User Content we deem to violate these Terms of Use or, or (b) to cancel the User Account from which such User Content made available on the Service.
User Content Responsibility
You acknowledge and agree that (a) you are solely responsible for all of your User Content, and (b) we may, but are not obligated to, review and delete or remove (without notice) any User Content, in our sole discretion, including, without limitation, any User Content that violates this Agreement. You agree that you must evaluate, and bear all risks associated with, the use of any User Content, including any reliance on the accuracy, completeness, or usefulness of such Content. In this regard, you acknowledge that you may not rely on any Service Content (except for these Terms and Services, the Privacy Policy and other legally binding agreements) for any purpose whatsoever.
Copyright Complaints
If you believe that any Content on the Service infringes upon any copyright or other intellectual property right that you own or control, you may send a written notification of such infringement to our Designated Agent

Infringer and Repeat Infringer Policy
In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, members who are deemed to be repeat infringers of intellectual property. We may also, at our sole discretion, limit access to the Service or terminate the User Account of any User who infringes any intellectual property rights of us or others, whether or not there is any repeat infringement.
Third Party Sites and Content
The Service may contain (or you may be presented with through the Service) links to other web sites (“Third Party Sites”) as well as Content belonging to or originating from parties other than us or our Users (the “Third Party Content”). Such Third Party Sites and Third Party Content are not investigated, monitored or checked for accuracy, appropriateness, or completeness by us, and we are not responsible for any Third Party Sites accessed through the Service or any Third Party Content available on the Service, including, without limitation, the content, accuracy, offensiveness, opinions, reliability or policies of or contained in the Third Party Sites or the Third Party Content. The inclusion of or linking to any Third Party Site or any Third Party Content does not imply approval or endorsement thereof by us. Modifications to Service
We reserve the right at any time and from time to time to perform maintenance on, to add to, to remove from, to make upgrades and updates to, to suspend, and to modify the Service or any part thereof with or without notice. NOTWITHSTANDING ANY PROVISION HEREIN, YOU AGREE THAT WE SHALL NOT BE LIABLE IN ANY MANNER TO YOU OR TO ANY THIRD PARTY FOR ANY SUCH MAINTENANCE, ADDITION, REMOVAL, UPGRADE, UPDATE, SUSPENSON OR MODIFICATION.
Advertisements
We may run advertisements and promotions on the Service. You agree that we have the right to run such advertisements and promotions. The manner, mode and extent of advertising by us on the Service is subject to change in our sole discretion.
General Practices regarding Use and Storage
You acknowledge that we may establish general practices and limits concerning use of the Service, including, without limitation, the maximum number of days that User Content will be retained by the Service, the maximum number of User Content that may be transmitted, posted, shared, used, copied, or otherwise made available on the Service (whether per User Account or globally), the maximum size of any User Content , the maximum disk space that will be allotted on the Service servers on any User’s behalf, and the maximum number of times (and the maximum duration for which) any User may access the Service in a given period of time. User-and-User Disputes
You are solely responsible for your interactions with other Users. We reserve the right, but have no obligation, to monitor disputes between you and other Users and to take any action with respect to any User Account pertaining to such Users, in our sole discretion.

Disclaimers
We are not responsible or liable in any manner for any User Content or Third Party Content available on the Service, whether made available or caused to be made available by Users or by any of the technology associated with or utilized in the Service. Although we provide these Terms of Use and other policies and rules for User conduct, we do not control and are not responsible for our Users actions and are not responsible for any Content you may encounter on the Service, be it User Content or Third Party Content. We are not responsible for the conduct, whether online or offline, of any User.
The Service may be temporarily unavailable from time to time for maintenance or other reasons. We assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, User Content. We are not responsible for any problems or technical malfunction, including, without limitation, any problem or malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email or persons, traffic congestion on the Internet or at any web site (including the those in the Service) or combination thereof.
THE SERVICE AND THE SERVICE CONTENT ARE PROVIDED “AS-IS” AND THE KINZIN COMPANIES DISCLAIM ANY AND ALL REPRESENTATIONS AND WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. THE KINZIN COMPANIES CANNOT GUARANTEE AND DO NOT PROMISE ANY SPECIFIC RESULTS FROM USE OF THE SERVICE. THE KINZIN COMPANIES DO NOT REPRESENT OR WARRANT THAT THE SERVICE CONTENT IS ACCURATE, COMPLETE, RELIABLE, CURRENT OR ERROR-FREE, OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THEREFORE, YOU SHOULD EXERCISE CAUTION IN THE USE AND DOWNLOADING OF ANY SUCH CONTENT AND USE INDUSTRY-RECOGNIZED SOFTWARE TO DETECT AND DISINFECT VIRUSES. Limitation on Liability

NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, THE KINZIN COMPANIES’ LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER, AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO THE KINZIN COMPANIES FOR THE SERVICE DURING YEAR IN WHICH YOUR SUCH CAUSE AROSE, BUT IN NO CASE WILL THE KINZIN COMPANIES’ LIABILITY TO YOU EXCEED $1000. YOU ACKNOWLEDGE THAT IF NO SUCH FEES ARE PAID BY YOU TO THE KINZIN COMPANIES FOR THE SERVICE, YOU SHALL BE LIMITED TO INJUNCTIVE RELIEF ONLY, UNLESS OTHERWISE PERMITTED BY LAW, AND SHALL NOT BE ENTITLED TO DAMAGES OF ANY KIND FROM THE KINZIN COMPANIES, REGARDLESS OF THE CAUSE OF ACTION.

Governing Law; Venue and Jurisdiction

You agree that the laws of the Province of British Columbia, Canada, without regard to principles of conflict of laws, will govern these Terms of Use and any dispute of any sort that might arise between you and us. You hereby irrevocably attorn to the exclusive jurisdiction of the Courts of the Province of British Columbia with respect to any dispute hereunder.
Indemnity
You agree to indemnify and hold the Kinzin Companies and each of their directors, officers, agents, contractors, partners and employees, harmless from and against any loss, liability, claim, demand, damages, costs and expenses, including reasonable attorney’s fees, arising out of or in connection with any User Content and any Third Party Content, your use of the Service, your conduct in connection with the Service or with other Users of the Service, or any violation of (a) these Terms of Use , (b) any law, or (c) any right of any third party.
Submissions
Notwithstanding any term herein related to User Content, you acknowledge and agree that any questions, comments, suggestions, ideas, feedback or other information about the Service (“Submissions”), provided by you to us are non-confidential and shall become the sole property of the Kinzin Companies, who shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination thereof for any purpose, commercial or otherwise, without acknowledgment or compensation to you.
Electronic Communications
When you use the Service or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail to the email address attached to your User Account through your Registration Data or by posting notices on (a) the Service at-large, (b) “The Zin” magazine (blog) site or (c) into your personal message centre available on the Service. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Merger or Acquisition
It is possible that any of the Kinzin Companies may be acquired or transferred as part of a merger, acquisition or other change of control. In the event of such a transaction, you understand and agree that we may assign our rights under these Terms of Use and that your personal information may be transferred to the succeeding entity in accordance with our Privacy Policy. You will be provided with reasonable notice and an opportunity to opt-out of the transfer.
Interpretation
Headings are for convenience only and shall not be used to interpret, or as a guide for interpretation of, these Terms of Use. The word “or” is not exclusive and the word “including” is not limiting (whether or not non-limiting language such as “without limitation” or “but not limited to” or other words of similar import are used with reference thereto). A word importing the masculine gender includes the feminine and neuter, a word in the singular includes the plural, a word importing a corporate entity includes an individual, and vice versa and “person” will mean an individual, partnership, corporation (including a business trust), joint stock company, trust unincorporated association, joint venture, or other entity or a government or any agency, department or instrumentality thereof and vice versa.
Other
These Terms of Use constitute the entire agreement between you and us regarding the use of the Service, superseding any prior agreements between you and us relating to your use of the Site or the Service. Our failure to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision in that or any other instance. If any provision of this Agreement is held invalid, unlawful, void or unenforceable for any reason, that provision shall be deemed severable and the remainder of this Agreement shall continue in full force and effect. These Terms of Use shall enure to the benefit of, and be binding upon, parties hereto and their respective heirs, executors, administrators, successors, and assigns.
